FunderPro Loyalty Program Terms & Conditions

FunderPro Ltd (hereinafter “FunderPro” and/or “the Company” and/or “We” and/or “our” and/or “us”) is a company organized and existent under the laws of Malta, registered with the Malta Business Registry under the registration number C 104558 and main place of business at ST Business Centre Balluta, Level 4, 196, Triq Censu Tabone, St. Julian’s Malta, Malta. 

We are pleased to introduce our loyalty program (hereinafter “FunderPro Loyalty Program” or “FLP”) designed for our customers. Our loyalty program operates under the Terms and Conditions (hereinafter the “T&Cs”) as set out below. By participating in the FLP you (hereinafter “You” and/or “your” and/or “the Customer”) agree to be bound by these Terms and Conditions as well as the General Terms and Conditions (the “GTCs”) and any other legal document that is available on our website at https://stg.funderpro.com 

Please read these T&Cs carefully. Should You have any objections, reservations, difficulty in fully understanding, or otherwise disagree with these T&Cs, whether completely or partially, you should neither use our Services or open an account and participate in the FunderPro Loyalty Program.

1. Introduction

1.1 These T&Cs shall apply in respect of the FunderPro Loyalty Program, which is designed to provide You with an opportunity to earn and collect points (hereinafter “FunderPro Tokens” or “FPTs”) and use them to redeem items (hereinafter “FunderPro Loyalty Rewards”) available in the widget in the bottom-right corner of your Dashboard (hereinafter “FunderPro Loyalty Widget”). 1.2 FLP is effective as of the 10th of July 2024 (hereinafter the “Participation Date”) and is set to run indefinitely except as per the provisions of clause 7 below.

2. Participation & Eligibility

2.1 By purchasing challenge(s),You automatically participate in any individual FLP  and earn points (hereinafter “FunderPro Tokens” or “FPTs”). No separate sign-up process is required. FLP is tied to your account. 

2.2 The participation to FLP is free. 

2.3 You are eligible to participate in the FLP only if You meet the criteria below: 

  • (a) eighteen (18) years of age, or older. By consenting to participate in the FLP, You confirm that You are eighteen (18) years-old and above; and residing in a country not listed as a prohibited jurisdiction in accordance with FunderPro’s general terms of service (available on our website, at https://stg.funderpro.com/). 
  • (b) You understand that there may be restrictions or laws in some jurisdictions that prohibit your participation in the FLP, further provided that any and all responsibility for the enrollment to participate in connection with the FLP in a manner strictly compliant under the relevant laws of your jurisdiction is exclusively yours. 

3. Conditions of participation

3.1 All information you provide to the Company at any time must be valid and accurate. You are responsible for updating your personal information as soon as there is an update by sending an email to our Customer Support. 

3.2 You consent to the collection, use and/or disclosure of your personal data by us, and You are responsible to review our Privacy Policy published on our website which outlines how We collect, use and disclose your data. If You have any questions or concerns regarding our Privacy Policy or the handling of your data, We encourage You to reach out to our Customer Support for assistance. 

3.3 You are not entitled to have more than one (1) account. 

4. Earning FastLoyal Tokens

4.1 You will earn FPTs based on the transactions, purchase of FunderPro challenges, on or after the Participation Date. 

4.2 Each transaction made with us will earn you ten (10) FPTs for every one (1) USD spent on a challenge. This means that for every 1 USD spent on our challenges, ten (10) FPTs will be credited to your account. Example: a transaction of 1,000 USD on challenges will result in 10,000 FPTs being credited to your account. New ways to earn FPTs may be added by the Company from time to time.

4.3 FPTs will be awarded for eligible transactions, which include payments made in full. It is the responsibility of the Customer to verify the accrual of FPTs earned in these eligible transactions. FPTs might take up to one (1) week to be credited to your account. Cancelled or refunded or partially paid transactions will not be eligible for FPTs. 

4.4 Any fraudulent activities detected, including but not limited to false transactions, manipulation, or misuse of the Loyalty Program to earn FPTs, will result in the immediate termination of the account and forfeiture of all accumulated FPTs.

5. Redeeming FastLoyal Tokens

5.1 Minimum number of FPTs You must collect so you can redeem any rewards is 5,500. 

5.2 You can redeem FPTs for rewards which may include any item available in the FunderPro Loyalty Marketplace (including, but not limited to coupons listed in clause 5.4).  

5.3 In order to redeem FPTs, You can open the  FunderPro Loyalty Widget, click on the FunderPro LoyaltyMarketplace on your Dashboard and select the desired reward. You will receive a confirmation email with the details. 

5.4  FPTs can be exchanged for FunderPro coupon codes as follows: 

  •   5,500 FPTs for a $50 coupon; 
  •   10,000 FPTs for a $100 coupon; 
  •   18,000 FPTs for a $200 coupon. 

5.5 In order to receive a reward, You should reach the target of each reward qualification requirements: 

  • (a) You can payout one reward at a time; 
  • (b) You cannot transfer FPTs between accounts; 
  • (c) You cannot transfer FPTs to other customers. 

5.6 FPTs l have no monetary value, and cannot be transferred, sold, exchanged or combined with FPTs for You or other customers. These FPTs are exclusively accessible to You as the account holder and cannot be converted into cash or any other form of monetary assets and/or any other items other than the ones listed in the FunderPro Loyalty Marketplace. Only one coupon can be used per purchase. 

6. Amendment

6.1 FunderPro reserves the right, in its sole discretion, to modify and/or amend the FLP or any part of it, at any time, without notice.

7. Termination and Disqualification

7.1 We reserve the right to terminate the FLP at any time, with or without cause, without prior notice and at our sole discretion. In that case, You will be provided thirty (30) days to redeem your accumulated FPTs in relation to the termination of the FLP and for any consequences resulting from such termination. Upon termination, all accrued and unused FPTs in your account will be immediately forfeited. 

7.2 You can terminate/cancel your account at any time and you may request assistance from our Customer Support if needed. Upon termination/cancellation, all accrued and unused FPTs in your account will be immediately forfeited. 

7.3 FunderPro reserves the right to disqualify You from the FLP under the following circumstances: 

  •  (a) if You violate any laws and/or applicable regulations and/or applicable regulations and/or the General Terms and Conditions and or these T&Cs. 
  •  (b) If You act in bad faith and/or abusively and/or fraudulently and/or in a manner that is not in line with these T&Cs; 
  •  (c) if there is reasonable suspicion that you act in bad faith and/or abusively and/or fraudulently and/or in manner that is not in line with these T&Cs. 

7.4 FunderPro reserves the right, at its sole discretion, to further disqualify You from any future promotion, should the Company suspects that You are subject to clause 7.3. 

7.5 In case an account is closed/blocked due to violation of these Terms and Conditions and/or the General Terms and Conditions, all generated FPTs will be nullified and forfeited; thus, You will not be able to claim any of the rewards.

8. Limitation of LiabilityLimitation of Liability

8.1 FunderPro is not liable for any unauthorized access to or alteration, theft, or destruction of FPTs as a result of any third-party actions. 

8.2 In the event of unexpected events, system failures, or errors, including but not limited to technical malfunctions, server downtime, or network congestion, the Company shall not be held liable for any delays, interruptions, inaccuracies, errors, or omissions arising from such occurrences. In addition, We shall not be responsible for any indirect or consequential damages, including but not limited to damages for loss of profits or data, or other intangible losses resulting from the use or inability to use the Loyalty Program due to unexpected events, system, failures, or errors. 

9. Governing Law

9.1 The T&Cs are governed by and construed in accordance with the Laws of Malta. The participant irrevocably agree that the courts of Malta shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the T&Cs or its subject matter or formation including, without limitation, non-contractual disputes or claims; provided further that this does not deprive or otherwise preclude the participants of the protection afforded to them by the mandatory laws of the relevant Member State of the European Union or any other relevant jurisdiction. 

10. Conflict

10.1 In the event of any conflict or inconsistency between the provisions of the T&Cs hereof and the GTCs, the provisions of the GTCs shall prevail.
